These Terms and Conditions ("Terms") govern your use of the Hearthline website at https://hearthlt.biz and the family records, documentation and coordination services we provide ("Services"). Please read them carefully before using the website or engaging our Services. By accessing this website or requesting a Service, you confirm that you accept these Terms.
1. Definitions
- "Agreement" means these Terms together with any written scope document agreed between you and Hearthline for a specific Service.
- "Service" means the Family Records Organisation Session, Household Schedule and Logistics Coordination, or Family Archive and Records Programme, as described on this website.
- "We / Us / Our" means Hearthline, registered at 34 Jalan Kristal 7/68, Seksyen 7, 40000 Shah Alam, Selangor, Malaysia.
- "You / User" means the individual or household that accesses this website or engages a Service.
- "Written Scope" means the document agreed in writing before each Service engagement, describing what is included, the price in Ringgit Malaysia, and the timeline.
- "Personal Data" has the meaning given in the Personal Data Protection Act 2010 of Malaysia.
2. Acceptance of these Terms
By using this website or requesting a Service, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are entering into this Agreement on behalf of a household or group of family members, you warrant that you have authority to do so on their behalf. These Terms take effect from the date you first use this website or submit an enquiry.
3. Service description
Hearthline provides administrative support services to Malaysian households. Our three services are:
- Family Records Organisation Session — A two-hour on-site session to sort, label and index household documents, with one follow-up call within 30 days. Price: RM 510.
- Household Schedule and Logistics Coordination — A three-month service maintaining a shared calendar, sending reminder notices and producing monthly summaries for two households. Price: RM 2,240.
- Family Archive and Records Programme — A complete archive project including scanning, structured storage, training and physical backup, running six to ten weeks. Price: RM 4,380.
Services are currently available to households located within Peninsular Malaysia. The exact scope of each Service is defined in a Written Scope agreed before work begins. We reserve the right to decline to provide a Service at our discretion.
4. Your responsibilities
- Provide accurate information when contacting us and during service delivery
- Ensure that relevant household members are available for sessions as agreed
- Inform us of any documents or items that should not be handled by us
- Keep login credentials for archive access confidential and notify us immediately if credentials are compromised
- Use this website only for lawful purposes and in a way that does not infringe the rights of others
- Not attempt to access any part of our systems or data beyond what is provided to you
5. Intellectual property
All content on this website — including text, layout and graphics — is owned by or licensed to Hearthline and is protected under Malaysian intellectual property law. You may not reproduce, copy or distribute website content without our written permission. The written index, archive structure and other outputs produced for you during a Service engagement belong to you from the date of production and are not subject to any licence from us.
6. Payment
- All prices are stated in Ringgit Malaysia (RM) and are inclusive of applicable taxes unless stated otherwise
- Payment arrangements are agreed as part of the Written Scope before any Service begins
- We accept payment by bank transfer to a Malaysian bank account; details are provided in the Written Scope
- Where work has already commenced and you cancel a Service, we reserve the right to charge for work completed up to the date of cancellation, prorated against the agreed price
- We do not issue refunds for completed Services except where we have materially failed to deliver what was agreed in the Written Scope
7. Service-specific terms
Records Organisation Session
- The session is conducted on-site at the household address agreed in the Written Scope
- The household is expected to have documents accessible and ready for sorting at the agreed time
- The follow-up call is available for 30 days from the session date and consists of one call of up to 30 minutes
Household Schedule and Logistics Coordination
- This service records and organises arrangements that both households have already agreed; we do not propose, interpret or adjudicate arrangements
- Both households must provide an initial list of agreed arrangements before the calendar can be built
- We are not responsible for the content of arrangements — only for recording and communicating them accurately
- The service period is three calendar months from the agreed start date
Family Archive and Records Programme
- The number of households and volume of documents must be agreed in the Written Scope before scanning begins
- Access is limited to a maximum of eight named individuals agreed at the start of the programme
- The family is responsible for maintaining the security of access credentials after handover
- Physical documents are not removed from the household premises; scanning is done on-site
- The programme timeline (6–10 weeks) is an estimate; actual duration depends on document volume
8. Disclaimers
Hearthline provides administrative services only. We do not provide legal, financial, welfare or any other professional advice, and nothing in our communications or outputs should be read as such. Families are encouraged to consult their own qualified professionals for decisions that require professional input.
This website and its content are provided on an "as is" basis. We make no representations about the accuracy, completeness or suitability of information on this website for any particular purpose. We do not warrant that the website will be uninterrupted or error-free.
9. Limitation of liability
To the extent permitted by Malaysian law, Hearthline's total liability to you in connection with any Service shall not exceed the amount you paid for that Service. We shall not be liable for indirect, consequential or special losses, loss of data (except where caused by our negligence in relation to digital archives), or loss of profits.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud or any liability that cannot be excluded under Malaysian law.
10. Indemnification
You agree to indemnify and hold harmless Hearthline and its staff from any claims, losses or expenses (including reasonable legal fees) arising from your breach of these Terms, your use of the Services in a manner not authorised by the Written Scope, or any misrepresentation made by you in connection with your engagement with us.
11. Termination
Either party may terminate a Service engagement by giving written notice. If you terminate before a Service is complete, we will charge for work completed to the date of termination. If we terminate because you have breached these Terms, no refund is due for amounts already paid. Sections 5, 8, 9, 10, 12 and 13 survive termination.
12. Governing law and dispute resolution
These Terms are governed by the laws of Malaysia. Any dispute arising from or in connection with these Terms or any Service shall first be referred to informal negotiation. If not resolved within 30 days, the dispute shall be subject to the non-exclusive jurisdiction of the courts of Malaysia. Parties may also agree to refer disputes to a mediator under the Mediation Act 2012 of Malaysia before commencing court proceedings.
13. General provisions
- Entire agreement: These Terms, together with the Written Scope for each Service, constitute the entire agreement between the parties regarding the relevant Service
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force
- Waiver: Failure to enforce any right under these Terms does not constitute a waiver of that right
- Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights to a successor entity
- Notices: Notices may be given by email to the addresses provided during the engagement
14. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Changes take effect immediately on publication. Your continued use of this website or Services after changes are published constitutes acceptance of the revised Terms. For material changes, we will provide notice by email where we hold your address.
